- GENERAL PROVISIONS
1.1. The organizer of the loyalty program is the company Amso Sp. z o.o. based in Krakow (business address and mailing address: Czarnowiejska 84, 30-054 Krakow); registered in the National Court Register (KRS) under number 0000944460; competent court where the company's documentation is kept: District Court for Krakow-Śródmieście in Krakow, XI. Economic Department; registered share capital of 30,000 PLN; tax identification number (NIP): 6772305518, registration number (REGON): 120634341, and email address: contact@amso.eu.
1.2. This loyalty program is addressed to both consumers and other parties entering into sales agreements for products with the organizer.
1.3. The loyalty program is organized through the online shop owned and operated by the organizer.
- DEFINITIONS
2.1. The terms used in these General Terms and Conditions have the following meanings:
2.1.1. CATALOG - Product catalog in which the customer can redeem their accumulated points, available in the online shop.
2.1.2. CUSTOMER - (1) a natural person with full legal capacity or, in cases provided for by applicable regulations, a natural person with limited legal capacity; (2) a legal person; or (3) a non-legal entity endowed with legal capacity by law, intending to participate or participating in the loyalty program.
2.1.3. CIVIL CODE - the Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
2.1.4. ORGANIZER - the company Amso SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ based in Krakow (business address and mailing address: Czarnowiejska 84, 30-054 Krakow); registered in the National Court Register (KRS) under number 0000944460; competent court where the company's documentation is kept: District Court for Krakow-Śródmieście in Krakow, XI. Economic Department; registered share capital of 30,000 PLN; tax identification number (NIP): 6772305518, registration number (REGON): 120634341, and email address: contact@amso.eu.
2.1.5. PRODUCT - an item or service that is the subject of a sales contract between the customer and the seller.
2.1.6. LOYALTY PROGRAM - a customer loyalty program organized by the organizer according to these General Terms and Conditions.
2.1.7. GENERAL TERMS AND CONDITIONS - these General Terms and Conditions of the loyalty program.
2.1.8. ONLINE SHOP - the organizer's online shop, accessible at the address: www.amso.eu, where this loyalty program is organized.
- TERMS OF PARTICIPATION IN THE LOYALTY PROGRAM
3.1. The customer can participate in the loyalty program. Participation in the loyalty program is voluntary.
3.2. The customer can participate in the loyalty program by filling out the registration form and checking the corresponding checkbox. The created account simultaneously serves as a customer account in the online shop. The registration form must include the following data: email address and password. A customer who already has an account in the online shop can join the loyalty program by selecting the corresponding function in the account settings.
3.1. The customer participating in the loyalty program is obligated to provide the data according to the actual state. The customer is required to update the provided data in case of any changes, especially by email to the address: contact@amso.eu or in writing to the address: Czarnowiejska 84, 30-054 Krakow.
- LOYALTY PROGRAM CONDITIONS
4.1. The loyalty program is effective from July 1, 2023, and has an indefinite duration. The customer retains the right to use the accumulated funds within three months after the program's completion.
4.2. Points are credited to the participating customer's account for completed purchase contracts for products in the online shop. The points are added to the user's account 30 days after the order status is changed to "shipped."
4.3. The number of points credited to the customer for the purchase contract of a product is displayed on the online shop's website in the description of each participating product in the loyalty program.
4.4. Points will not be credited to the customer for a purchase contract for a product:
4.4.1. for which the customer received an additional discount due to agreements with the seller or if the customer has a permanent discount in the online shop;
4.4.2. that the customer has returned;
4.4.3. from which the customer has withdrawn, e.g., by canceling the purchase.
4.5. After completing the purchase contract for a product, the organizer increases the number of points assigned to the customer on their account in the online shop. In addition to the ability to independently check the number of collected points within the customer account, the customer also has the right at any time to obtain information from the organizer about the number of points. For this purpose, the customer can contact the organizer, especially by email at the address: contact@amso.eu or in writing at the address: Czarnowiejska 84, 30-044 Krakow.
4.6. The price of a product expressed in loyalty points is based on a conversion rate of 25 points = 1 euro of the product’s gross value. The number of points required to purchase a product corresponds to its current euro price based on this fixed rate.
- USE OF POINTS
5.1. The customer is entitled to exchange the allocated funds for a product from the catalog available in the online shop.
5.2. The number of points required for exchange for a product from the catalog available in the online shop is specified in the description of each product in the catalog.
5.3. Points assigned to the customer can be used by the customer indefinitely.
5.4. The customer bears the cost of delivering the product from the catalog.
5.5. The loyalty program cannot be combined with other promotions, sales, and other loyalty and partner programs in the online shop unless stated otherwise in the offer.
5.6. The accumulated funds cannot be withdrawn by the customer.
5.7. The sponsor of the rewards is the organizer.
- PERSONAL DATA
6.1. The organizer is responsible for processing personal data related to the implementation of the provisions of these terms and conditions. Personal data is processed for the purposes, to the extent, and based on the principles specified in this section of the terms and conditions. Providing personal data is voluntary, but failure to provide the personal data required for participation in the loyalty program will result in rejection of participation.
6.2. The purpose of collecting customer data by the organizer is to conduct the loyalty program.
6.3. The processing of the customer's personal data is based on the necessity for the performance of a contract in which the customer is involved or to carry out pre-contractual measures at their request.
6.4. Every individual has the right to control the processing of their personal data contained in the organizer's database. In particular, they have the right to: request supplementation, updating, or correction of personal data, temporary or permanent suspension of data processing, or deletion of data if it is incomplete, outdated, inaccurate, or unlawfully collected, or no longer necessary for the purpose for which it was collected.
6.5. To exercise the above-mentioned rights, a corresponding notification can be sent by email to the address contact@amso.eu or in writing to the organizer's address, Czarnowiejska 84, 30-054 Krakow.
- TERMS FOR TERMINATION OF THE LOYALTY PROGRAM
7.1. The customer can withdraw from participation in the loyalty program at any time and without giving reasons by selecting the corresponding option in their account or by sending a corresponding declaration to the organizer, e.g., by email to contact@amso.eu or in writing to the address Czarnowiejska 84, 30-054 Krakow. The withdrawal takes effect immediately.
7.2. Amso will make every reasonable effort to ensure the smooth running of the loyalty program but assumes no responsibility for any disruptions or defects.
7.3. Amso reserves the right to change the loyalty program and its conditions with 30 days' notice to the participants.
7.4. Amso reserves the right to suspend or terminate the program, provided that members are notified at least 30 days in advance. Upon termination of the loyalty program, members who have acquired benefits can continue to use them for the remaining period.
- COMPLAINT PROCEDURE
8.1. The customer can submit complaints related to the loyalty program, for example, by email to the address contact@amso.eu or in writing to the address Czarnowiejska 84, 30-054 Krakow.
8.2. It is recommended to provide as much information and details as possible in the description of the complaint related to the subject of the complaint, especially the nature and date of the occurrence of irregularities, as well as contact details. This facilitates and accelerates the processing of the complaint by the organizer. The requirements mentioned in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description.
8.3. The organizer will respond promptly, but no later than 14 days after the complaint is submitted.
- FINAL PROVISIONS
9.1. These terms are subject to German law.
9.2. A member may seek mediation to settle consumer disputes with Amso, provided that (i) they have previously contacted Amso's customer service in writing, and no solution has been found, and (ii) their request is not obviously unfounded or abusive. The European Commission provides an online dispute resolution platform available to consumers and businesses at the following address: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show&lng=EN.
9.3. All disputes arising from these terms are subject to the exclusive jurisdiction of German courts, including warranty claims or multiple defendants.
9.4. Any change, suspension, or termination of the loyalty program does not entitle the member to compensation.
9.5. Amso reserves the right to suspend or deactivate the member's account, leading to the cancellation of the points received, without the member being entitled to compensation:
9.5.1. For actions that disrupt the proper functioning of the loyalty program, especially fraud, attempted fraud, or unlawful use or attempted use of the benefits offered under the loyalty program;
9.5.2. Generally, for non-compliance with these general terms and conditions of the loyalty program.
